Dr Bhullar wins on appeal

Not so long ago I wrote about Dr Bhullar getting his veterinary license back- he had been suspended by the BCVMA ( now College of Veterinarians)

The College appealed this decision, hoping to keep Dr Bhullar 'erased' from the registrar, but Dr Bhullar won on appeal.


This comes directly from the court transcript:


There were numerous grounds of appeal, but in view of the limited time set aside for the hearing, Mr. Justice Saunders dealt only with three of the issues and adjourned the balance of the issues.

He ruled against Dr. Bhullar on the first issue, which dealt with the composition of the inquiry committee that heard evidence with respect to the charges of misconduct against Dr. Bhullar.

He ruled in favour of Dr. Bhullar on the second and third issues, holding that members of the council who were elected after the council’s hearing should have participated in the decision and that the inquiry committee and the council had erred in holding that they did not have the jurisdiction to hear Dr. Bhullar’s allegations of institutional bias and discrimination.

On the latter issue, Mr. Justice Saunders followed the decision in Bajwa v. B.C. Veterinary Medical Association, 2009 BCSC 1047. I understand that the decision in Bajwa has been appealed by the Association, and that judgment on the appeal has been reserved following the hearing of the appeal.

In my opinion, it has not been shown that it would be in the interests of justice to grant the stay and, accordingly, I dismiss the application with costs in the cause of the appeal.

P.S. Congratulations to Dr Bhullar- this has been a long and protracted battle.

So what am I doing?

Well first I am paying off the last of the College legal fees- part of the ruling was that I am obligated to pay the College's legal expenses.

I am slowly adjusting to life at home, and working on the internet- but I am missing much of practice.

I am in the reflective phase, although what has happened with Dr Bhullar does inspire me.
