Tennessee has had a problem for many years as a result of an overly
aggressive statute that makes it a criminal offense to even walk on
property (public or private) that is posted. This statute is much
harsher than the typical “trespass” statute which requires that the
property owner or manager ask the individual to “comply” and there must
be a refusal to do so before criminal charges could even be brought.
SB 441/HB 478
(sponsored by Senator Paul Bailey and Representative Ed Butler) is a
common-sense bill that protects responsible gun owners from unnecessary
criminal charges. As noted, under current law (TCA 39-17-1359),
individuals who unknowingly carry a firearm into a posted area could
face legal penalties and the forfeiture of their firearm, even if they
immediately leave or secure their firearm in their vehicle upon request.
This bill ensures that law-abiding citizens are given the opportunity
to comply with property restrictions without facing criminal
consequences. By striking a balance between property rights and Second
Amendment protections, SB 441/HB 478 promotes fairness while respecting
the rights of all Tennesseans.

Also, get busy contacting your legislators on other issues too! Let them know that you are insisting that they pass truly pro-Second Amendment laws such as:
- A constitutional amendment to make Tennessee’s constitution consistent with the Second Amendment
- Enact Real Constitutional Carry
- Eliminate the ban on carrying longarms
- Eliminate Gun Free Zones
- Make the violation of Second Amendment rights a civil rights violation under state law
- Change the law to allow citizens to effectively defend their home and property from criminals
- Stop anything that looks like a Red Flag law
Finally, if you conclude that Tennessee's laws do not fully satisfy the Second Amendment's "shall not be infringed" mandate, call the Governor, call these Republican Legislative leaders, and call your own legislators and ask them "Why, why does Tennessee violate the Second Amendment?"
