Breaking: NLRB Overturns Three Trump-Era Policies

by Michael VanDervort

The National Labor Relations Board (NLRB) has made several policy changes, rolling back three Trump-era policies to bolster voluntary union recognition.

Here's what you need to know:

Blocking Charge Policy Revived: The NLRB reinstated its blocking charge policy, allowing election pauses (including decertification votes) when unfair labor practices are alleged. This seems to be the most significant of the three changes.

Six-Month Bar on Decertification Petitions Restored: Voluntarily recognized unions now have six-month protection from decertification challenges, eliminating the previous 45-day window.

Eased Voluntary Bargaining in Construction: New rules facilitate voluntary bargaining relationships within the construction industry.

Effective Date: These regulations will take effect in late September.

NLRB member Marvin Kaplan, the sole Republican on the board, dissented.
