Update on USDA Order for Further Testing of Raw Milk for H5N1 (Avian Flu)

This is an evolving situation. FTCLDF will continue to monitor developments and post new information as it becomes available.


FTCLDF reported on December 6, 2024 that USDA APHIS (Animal and Plant Health Inspection Service) issued an order that would apply to raw milk producers providing wholesome, raw milk for human consumption.


It is now the understanding of FTCLDF that USDA APHIS will NOT be testing raw milk provided directly to consumers, or intended for raw aged cheese. The USDA has communicated, however, that state programs may begin testing as part of state surveillance, and the USDA has not ruled out testing raw milk for human consumption in the future.

Injunction Issued Stopping Corporate Transparency Act Reporting!

The beneficial ownership information (BOI) reporting requirement is on hold after a federal Texas judge issued a preliminary injunction applicable to all reporting companies nationwide. The injunction was in response to a lawsuit brought by the National Federation of Independent Business (NFIB) and five other businesses to challenge the constitutionality of the new reporting requirement.

As state legislative sessions across the country have come to an end, we wanted to share the progress of some of the important legislative pieces we have been tracking and engaging in across 14 states.

FTCLDF Signs onto the LOCAL Foods Act to Benefit On-Farm Slaughter

Farm-to-Consumer Legal Defense Fund is one of dozens of organizations, and more than 600 signatories from across the country to support a petition by Rural Vermont to improve the Federal Meat Inspection Act (FMIA).


Currently, FMIA only allows farmers to raise, slaughter, and butcher their animals without inspection for their personal use, not sold to customers.


On Sept.19, 2024, Senators Peter Welch (D-VT), Bernie Sanders (I-VT), and Cory Booker (D-NJ) introduced the Livestock Owned by Communities to Advance Local (LOCAL) Foods Act (S.5106) to permanently protect the ability of livestock farmers, consumers, custom processors, and itinerant slaughterers to practice and benefit from on-farm slaughter.
