Tennessee House Bill 0130 would expand access to cottage/homemade foods in Tennessee by allowing a homemade food item to be produced by or under the direct supervision of the producer at the producer's residence.
Products allowed include non-time/temperature control for safety foods, or time/temperature control for safety food. Foods not allowed include alcoholic beverages, unpasteurized milk or foods that are, or that contain, alcoholic beverages, fish and shellfish products, meat, meat by-products, poultry, or poultry by-products, except to the extent that the sale of those items is permissible under federal law.
Labelling requirements must be met, and foods that do not contain dairy, meat or poultry can be sold either by the producer, in-person or remotely to the consumer, or by an agent of the producer or a third-party vendor, such as a retail shop or grocery store.
Foods that do contain dairy, meat, or poultry can only be sold by the producer direct to the consumer, in-person or remotely, and must be delivered by the producer to the consumer. Current cottage food law does not allow the sale of any foods time/temperature controlled for safety and does not allow agents of the producer to make or sell homemade foods on their behalf.
The hearing on this bill will take place at 3 p.m. EST on Wednesday Mar. 19, 2025, in House Hearing Room III.
