ACTION ALERT: Act Now for Cottage Homemade Foods in TN! Hearing is March 19!

Strength in Numbers

Dear Friend,

Tennessee House Bill 0130 would expand access to cottage/homemade foods in Tennessee by allowing a homemade food item to be produced by or under the direct supervision of the producer at the producer's residence.


Products allowed include non-time/temperature control for safety foods, or time/temperature control for safety food. Foods not allowed include alcoholic beverages, unpasteurized milk or foods that are, or that contain, alcoholic beverages, fish and shellfish products, meat, meat by-products, poultry, or poultry by-products, except to the extent that the sale of those items is permissible under federal law.


Labelling requirements must be met, and foods that do not contain dairy, meat or poultry can be sold either by the producer, in-person or remotely to the consumer, or by an agent of the producer or a third-party vendor, such as a retail shop or grocery store.


Foods that do contain dairy, meat, or poultry can only be sold by the producer direct to the consumer, in-person or remotely, and must be delivered by the producer to the consumer. Current cottage food law does not allow the sale of any foods time/temperature controlled for safety and does not allow agents of the producer to make or sell homemade foods on their behalf.


The hearing on this bill will take place at 3 p.m. EST on Wednesday Mar. 19, 2025, in House Hearing Room III.

Talking Points


1. Passage of the HB 0130 would enable family farmers to make a better living by increasing the allowable homemade foods that can be sold, by increasing sales avenues, and by allowable producer’s to use agents to in their homemade foods operations.


2.HB 0130 would increase consumer freedom of choice by allowing great access to homemade foods made by local producers.


3.HB 0130 would enable small, independent farms to make a better living by increasing the products they can sell that consumers want.


4.HB 0130 would keep more of the food dollar in local communities with the increase in locally-produced foods consumers can obtain.
