Jeff Korek & Michael Fruhling Published on BestLawyers.com: Medical Malpractice Litigation Differences In New York and New Jersey
Based upon the line that divides the states of New York and New Jersey, a patient injured as a result of medical malpractice will see a dramatic difference in both the viability of their case and the way it will proceed to trial.

A patient’s medical malpractice claim in the state of New jersey is subject to the affidavit of merit stuatue, N.J.S.A. 2A:53A-26 to -29, and the New Jersey Medical Care Access and Responsibility and Patients First Act, N.J.S.A. 2A:53A-41. The initial purpose of these acts was to require a plaintiff to reach “a threshold showing that their claim is meritorious, in order that meritless lawsuits readily could be identified at an early state of litigation.”[1]

These acts place an obligation on the plaintiff and the defendant involved in malpractice cases to retain qualified experts. However, the goal of the affidavit of merit statute has recently been whittled away...
31 New York Construction Workers Dead In 2 Years
A December 23rd fatal construction accident on the Upper East Side of New York City marked the 31st worker to die on the job in the city in the past two years. The worker, whose name has not yet been released, was working on a nonunion work site. The worker was apparently wearing a harness but was not hooked to a cable when he fell.

Only three weeks earlier, Wilfredo Enriquez fell to his death at the old Domino Sugar Factory in Brooklyn, marking death 30. Deaths 27 and 28 occurred on November 22nd, when a steel beam fell four stories at a Queens job site, crushing George Smith and Elizandro Enriquez Ramos.

Construction accident fatalities have become a public health epidemic that is brought on by inadequate safety regulations and public inattention. The lack of safety on construction sites happen because it pays for companies to run the risk of letting them happen.

The 5 Star GLK Experience
GLK Provides 33 Kids With a Memorable Opportunity at the New York Knicks
My wife and I have been in lawsuit for the past 4 years and it was successfully settled yesterday, just prior to the trial starting. We feel that the service, passion, and commitment by Ed Gersowitz and Jeff Korek was beyond what one would expect from Legal representation... Due to this, my Wife was able to receive the best available services and treatments to heal as quickly as possible. We did not expect this service, and along with their wonderful attention and guidance throughout the Legal process they made a difficult situation much more manageable. As we also learned, they are very highly respected in the Courts and by their peers, which provided us a great sense of comfort. We would highly recommend working with their team!!

The attorneys at Gersowitz Libo & Korek, P.C., in collaboration with The Gardiner Foundation, provided 33 children and their parents with a memorable Martin Luther King’s Day by providing tickets to the New York Knicks v. Atlanta Hawks game on Tuesday, January 17, 2017 at “the world’s most famous arena.” Madison Square Garden. This experience was unforgettable for most of these children because it was their first time attending The Garden.

The children were accompanied by Dexter Gardiner, founder of The Gardiner Foundation, which was established to provide emotional and financial support to families who have experienced the unexpected and tragic loss of a loved one.
