Tom Cruise Movie Production Crash Leads to Wrongful Death Lawsuit Filed Against Production Companies by GLK
Gersowitz Libo & Korek, P.C. filed a wrongful death lawsuit against several production companies involved with the movie American Made, formerly known as Mena, starring Tom Cruise. The firm filed the lawsuit on behalf of the estate of Carlos Berl, who died in a plane crash that occurred during the movie’s filming in South America.

The suit alleges that the production companies permitted for the dangerous flight to go forward without proper supervision or training, resulting in the deadly crash that killed two of its occupants. Berl had informed the productions companies before leaving the U.S. that he had insufficient flight experience in the Subject Aircraft and required flight instruction and familiarization with the aircraft before he could safely pilot it. His requests were completely ignored. The production companies were responsible for making sure that the flights in connection with or in support of the production were operated in a safe manner. 
Lawsuit Resolution Finally Brings Closure For the Family of the Tragic 2010 Manhole Death Victim in Tarrytown
On September 7, 2010, John Kelly, a long-time member of the Tarrytown Fire Department, tried to save Anthony Ruggiero, a Village DPW worker, after he collapsed at the bottom of a cramped 20-foot-deep manhole behind Consolidated Engine Fire House in Tarrytown. Unfortunately, halfway down the manhole, Kelly looked up, his eyes rolled back, and he fell the rest of the way down. They were both pronounced dead later that day due to asphyxiation from low oxygen levels.

Kelly’s estate, represented by Jeff Korek of Gersowitz Libo & Korek, P.C., filed a lawsuit alleging negligence and recklessness by the village and other agencies in failing to train village workers or providing a safe work environment. The goal of the lawsuit was for those responsible to take ownership for the tragic event and for Kelly’s loved ones to finally get some answers.
