Wrongful Death Due to Falling Tree Branch in New Jersey Park
A 3-year-old toddler died after being struck by a 20-foot tree limb while camping at camp grounds located in New Jersey. Defendants denied responsibility, arguing that the tree limb fell as an “act of god” and they had no notice of the condition of the tree. Gersowitz, Libo & Korek P.C., retained one of the foremost tree experts in the State, who opined that the camp grounds failed to have a formal tree risk assessment program throughout its campsite and that the subject tree showed visible signs of decay. A multimillion dollar settlement was achieved on behalf of the family for their emotional pain in witnessing this horrific accident, as well as for the tragic death of their child. | | New Jersey Construction Worker Who Fell from A Scaffold.
A settlement in excess of 6 million dollars was reached for an undocumented New Jersey construction worker who was not wearing his safety harness, when he fell 4 stories as a result of a defective scaffold. The construction worker, who had immigrated to New Jersey, suffered a traumatic brain injury, multiple spinal, chest, and facial fractures that required surgical intervention. |
| | Wrongful Death from Severe Burns in a NY State Psychiatric Facility
Wrongful Death – Pain and Suffering: An inpatient resident of a New York State owned psychiatric facility in Bronx, New York was caused to be set on fire by a cigarette lighter she brought back into her room, which is considered contraband that was prohibited from possessing on her person or in her room. As a result of the fire, she suffered burns to over half of her total body surface area and underwent several surgeries requiring skin grafting and debridement, which ultimately resulted in her death over five months later. Her sisters were appointed administrators of the estate while Defendants denied responsibility and blamed the patient for lighting herself on fire. After obtaining surveillance videos and deposing all of the employees involved in the patient’s care, the case settled for $2,000,000 while conducting a pre-trial conference in the Court of Claims. |
