GLK Opens #MeToo Practice with Colleen Meenan
As part of the firm’s ongoing efforts to broaden the range of services provided to their clients, Colleen M. Meenan has joined as Of Counsel to handle #MeToo and Workplace Compliance lawsuits.

“We are thrilled to welcome Colleen as an important addition to our firm as we continue to grow our team and the different services we provide our clients,” said Jeff S. Korek, Senior Trial Partner at Gersowitz Libo & Korek, P.C.

Colleen has developed insightful legal strategies in advancing women’s rights for over 28 years. Before practicing law, Colleen was a decorated New York City police officer and through this first-hand experience understands all too well the difficulties women face in the workplace.
Colleen is an executive board member of NELA/NY, the local affiliate of the National Employment Lawyers Association (NELA), a national organization for lawyers who promote the workplace rights of individual employees through legislation, education and litigation. Colleen is also a member of the New York State Trial Lawyers Association.

Colleen is well-known for her uncompromising advocacy and has obtained a number of successful employment related jury verdicts for her clients, including in the cases of Elliot v. City of New York, 99-cv-9308 (SDNY)(Mukasey) and Sorrenti v. City of New York, Index 126981/02 (N.Y. Co. Sup. Ct.).

Significant jury awards she has obtained for clients have been affirmed by the New York State Court of Appeals in the cases of Albunio v. City of New York, 16 N.Y.3d 472 (2011) and Sandiford v. City of New York, 22 N.Y. 3d 914 (2013). These favorable appellate court decisions clarified the interpretation to be applied by the trial courts in analyzing claims of retaliation under the New York City Human Rights Law.

If you or a loved one has been the victim of workplace discrimination or sexual harassment, you deserve an experienced #MeToo attorney who knows how best to present your case and defend your legal rights.

Recent Settlements & Verdicts
$3.25 million Premises Liability Settlement: In Bronx County Supreme Court, Senior Trial Partner Jeff S. Korek and Anthony Makarov were able to achieve this significant result. A 38 year old wife and mother of two children suffered serious injuries to her right shoulder and scapula when she was hit with a pipe that had been dropped 18 floors above from a scaffold in Manhattan. Summary judgment on the issue of liability was achieved before trial and a settlement in the amount of 3.25 million was reached on behalf of the wife and husband once a jury was selected and the case was ready to proceed to trial on the issue of damages.

$600,000 Trip and Fall Settlement: Associate Avi Laby obtained a settlement in the amount of $600,000 prior to closing arguments in a week and a half long jury trial in Westchester County. Client was an 80 year old retired mother and grandmother who was caused to fall on Defendants’ premises when her right foot caught on a raised and mis-leveled portion of the walkway. Our client sustained a fractured patella of the right knee, a fractured humerus of the left shoulder and a fractured distal radius of the left wrist, all of which required open reduction internal fixation surgeries.

$587,000 Motor Vehicle Verdict: Associate, Anthony Makarov, recently obtained a $587,000 jury verdict for a 69 year-old woman in Queens who suffered broken ribs and clavicle (no surgery) in an intersection car accident after proving the green light driver was also at fault in addition to the red light driver.
New York Lawmakers Seek to Compensate Emotional Loss by Overhauling Wrongful Death Statute
Lawmakers in New York are seeking to expand the state’s wrongful death statute to allow compensation for things such as grief or loss of love and companionship in the year’s legislative session. Currently, New York laws only allow individuals to seek compensation based on the amount of potential income lost from the death of their loved one. This can, and often does, place limits on litigation of wrongful death claims.

Wrongful death victims can also seek damages for pain and suffering, but this new legislation allows lawmakers to expand the list of compensable factors to include other items that juries cannot currently consider when evaluating compensation.

In short, if the new legislation passes, it would allow wrongful death victims to seek compensation for love, society, protection comfort, companionship and consortium resulting from the death of their loved one. The new law would also provide damages for grief, anguish or emotional loss caused by the death. These damages would be in addition to any pecuniary damages that would result from the death, such as loss of potential income, support or diminishment of inheritance.
