BREAKING: New York Legislature Passes Child Victims Act
A bill to raise the statute of limitations in cases of child sex abuse, called the Child Victims Act, passed the New York legislature Assembly on Monday, January 28th. The legislation raises the age at which victims can bring both civil and criminal cases against their alleged abusers. It also creates a one-year period for individuals who were the victims of child sex abuse and whose statute of limitations has already expired to file a civil claim against their abuser and/or the entities who were responsible for the oversight or who employed their abuser.

From a press release issued last week, Governor Cuomo notes that for too long, society has failed these survivors of abuse and their traumas at the hands of authority figures have only been compounded by a justice system that denied them their day in court. He further noted that the time is to end this heinous injustice and give these victims their day in court.

Details of the Child Victims Act

The law itself has not changed. The bill removes the need to file a notice of claim or notice of intention to file a claim against a municipal, city or state agency in all sexual abuse/assault cases that occurred when that person was under the age of 18.

This was not the first time Mr. Korek has pursued immigration rights in the U.S. Jeff is active in discussing and meeting with Congressmen and others who are working on the border wall and immigration battle. Mr. Korek, and the rest of the team at Gersowitz Libo & Korek, P.C., continue to fight for the rights of immigrants who often are unaware that they have most of the same legal protections as Americans when it comes to pursuing their rights when injured as a result of the wrongdoing of others

Holding Schools Liable for Accidental Deaths: Death of Queens High School Student Raises Questions
Just days after celebrating the holiday season, a 16-year-old Queens boy collapsed and went into cardiac arrest at basketball practice at John Bowne High School in Flushing on December 27th. According to NBC news, his coaches performed CPR on him before EMS responded and transported him to the hospital, where he was pronounced dead. News sources state that he was already on life support by the time his mother got to the hospital.

His mother told the media that he did not have any health problems or allergies and was not on any medication. The New York City medical examiner’s office is investigating the unexpected death.

School’s Liability in Accidental Deaths

Schools have the responsibility to maintain a safe environment for students. School officials act in loco parentis, which is just a fancy way of saying “in the place of parents,” when children are in their care at school. They have the responsibility to prevent foreseeable dangers from harming students.

Gardiner Foundation Toy Drive a Huge Success Again!
The Gardiner Foundation has been helping those most in need in the South Bronx for the past 10 years. On Saturday December 22, the Gardiner Foundation and Gersowitz Libo and Korek, P.C. hosted The Gardiner Annual Toy Drive at P.S. 86 in the Bronx.

This year, 530 children ages newborn to 15 received a gift from Santa! Over 400 Christmas stocking were also given. A special thank you to everyone for your continued support.
