The Price is Right— Understanding How Jury's Really Work in Employment Litigation

The average law suit costs more than $100,000 to take to motion for summary judgment. Although the odds are overwhelming in favor of the employer and employment litigation, a significant number of cases survive summary judgment and still get a trial. The average cost to defend a corporation in a litigated employment trial is over $250,000. But that is not the bad news! Jury’s come to widely divergent conclusions regarding the same set of facts. And, even the most knowledgeable human resources professionals don’t agree on how a case should be resolved. If the HR professionals, with their SHRM certification, can’t come to the same conclusion; then, what hope is there for the average citizen?
Jonathan Martin will analyze several recent jury verdicts under Title VII, the ADA, FMLA, the #MeToo Movement, and other labor and employment laws. Jonathan will provide an overview of the legislation, practical tips from employers, and most importantly will put HR professionals in the role of “Jury” to allow them to analyze recent cases and reach a conclusion.
The HR professionals will be amazed at how in the same room, with the same facts, with the same experience, the outcomes will differ widely. The lesson; avoid litigation at all cost through positive employer relations, a knowledge of recent legal developments, an effective HR function, and other tragedies to avoid litigation.
