Understanding How Jury's Really Work in Employment Litigation

The average law suit costs more than $100,000 to take to motion for summary judgment. Although the odds are overwhelming in favor of the employer and employment litigation, a significant number of cases survive summary judgment and still get a trial. The average cost to defend a corporation in a litigated employment trial is over $250,000. But that is not the bad news! Jury’s come to widely divergent conclusions regarding the same set of facts. And, even the most knowledgeable human resources professionals don’t agree on how a case should be resolved. If the HR professionals, with their SHRM certification, can’t come to the same conclusion; then, what hope is there for the average citizen?

Jonathan Martin, a Partner with National Employment Labor Law Firm, Constangy, Brooks, Smith & Prophete, will analyze several recent jury verdicts under Title VII, the ADA, FMLA, the #MeToo Movement, and other labor and employment laws. Jonathan will provide an overview of the legislation, practical tips from employers, and most importantly will put HR professionals in the role of “Jury” to allow them to analyze recent cases and reach a conclusion. The HR professionals will be amazed at how in the same room, with the same facts, with the same experience, the outcomes will differ widely. The lesson; avoid litigation at all cost through positive employer relations, a knowledge of recent legal developments, an effective HR function, and other tragedies to avoid litigation.

GEA Board Member Spotlight: Al Ertel

In an effort to familiarize our members with the GEA Board of Directors, we are spotlighting the hardworking and dedicated Board Members that strive to make GEA a beneficial and resource-driven organization.

With over 25 years of experience in the health insurance industry, Al Ertel has positioned himself to be a steadfast proponent of purposely innovative quality managed healthcare programs. As Chief Executive Officer of Secure Health, starting in 2015, his mantra is “keeping healthcare local” focuses on access and delivery of healthcare within local communities. Keeping the care local keeps the money there too, further supporting financial stability in many markets. Previously, Mr. Ertel was with Alliant Health Plans for 10 years as their Chief Operations Officer. His leadership helped move that company’s operations from “outhouse to outstanding” transforming less than $100,000 reserves and $6 million in debt to eliminating the debt and gaining over $20 million in capital. Additionally, during his tenure, the owner providers earned an additional $13 million in bonus payouts for managing their patients care. He helped grow membership to over 30,000 members while there.

Mr. Ertel serves on the Georgia Chamber Health and Wellness and Small Business Committees. He is an active board member of the Greater Macon Chamber of Commerce, the National Association of Insurance and Financial Advisors (NAIFA), National Association of Health Underwriters (NAHU) and has been is a licensed Life and Health agent since 1986. He previously served on the Georgia Governor’s Committee on Health Insurance Exchanges and the Special Advisory Commission on Mandated Health Insurance Benefits. He holds a BS in Business Administration from Western New England University in Springfield, MA.
