Letters for use in Court Procedure
I’ve posted two letters which I’ve drawn up for use in court
situations. I’d like your suggestions on
how we can improve them.
#1…is a letter to the court clerk advising her that you’re
aware of what they do with the securitization of the court cases, and asking
for the CUSIP Number of the instrument to which this case is ultimately bundled
with. Since that information involves
the use of your NAME you will need that for 1099 purposes. The entire purpose
of the letter is to simply put them on notice that you are aware of their
‘business’, make their eyes as wide as pancakes, put the fear of God into them
and with a little luck and divine providence, perhaps they would just drop the
case rather than mess with you.
#2… is a letter to the prosecutor seeking administrative
remedy with your offer to settle the matter, given that he can provide certain
things required by law and a valid claim.
By taking this approach you can legitimately NOTICE THE COURT that you
are seeking administrative remedy with the prosecutor, thus there is no dispute
and until that changes, the court has no jurisdiction over ‘no valid claim’ but
officially ‘no dispute’ and you have not yet exhausted your administrative
remedies, thus there is no claim upon which relief can be granted.
